Diputado Saffirio (DC) pide a grandes tiendas y supermercados “no abusar de empaquetadores y respetar horas de descanso y alimentación”

Miles de jóvenes se suman en estos días al número estable de empaquetadores con motivo de la temporada navideña. Parlamentario DC, autor del proyecto que regulará esta actividad, pide “respeto y buenas prácticas hacia los jóvenes que realizan este trabajo temporal”.

Un llamado a las grandes tiendas y a los supermercados efectuó hoy el diputado DC René Saffirio, con motivo del aumento de jóvenes que, en esta época del año, ofrecen sus servicios como empaquetadores, refiriéndose a las “buenas prácticas y al respeto a las horas de descanso y alimentación que, como mínimo, requieren quienes se suman a esta tareas en forma temporal".

Al respecto, señaló que “mientras no se apruebe la ley, esta es tierra de nadie y lamentablemente surgen abusos. Sabemos que en algunas tiendas se les está pagando el sueldo mínimo, pero, en otras, sólo reciben propinas. La verdad es que esperamos tener pronto la nueva legislación, e insistimos al Gobierno para que le ponga urgencia a nuestro proyecto; pero, mientras ello no ocurra, apelamos a la ética de los empleadores para evitar abusos, especialmente con los horarios”.

Saffirio señaló que el proyecto del Gobierno en esta materia “no soluciona el problema de fondo y, es más, atenta contra la misión fundamental del Ministerio del Trabajo, que es fiscalizar y promover el cumplimiento de las normativas laborales, ya que , para estos casos, sólo contemplaría un seguro, vulnerando derechos sustanciales de estos jóvenes trabajadores. Nosotros proponemos un contrato y una serie de otras normas que efectivamente regulen esta actividad como corresponde. Por eso, apelamos al buen criterio de las autoridades y esperamos que le den patrocinio a nuestro proyecto”.

El parlamentario DC ingresó en abril de este año, junto a los diputados Carolina Goic y Matías Walker, un proyecto de ley que modifica el Código del Trabajo, estableciendo un contrato especial para trabajadores del comercio que se desempeñan como empaquetadores. El proyecto busca formalizar la relación laboral de hecho que existe entre estos trabajadores y los establecimientos de comercio. “Para ello, se plantea la necesidad de establecer un contrato de trabajo especial que, por una parte, proteja jurídicamente al trabajador y, por la otra, favorezca su contratación por parte del empleador”.

Además, la iniciativa se hace cargo de las normas especiales de protección de los menores de edad de 15 a 17 años, toda vez que una parte importante de tales trabajadores se encuentran en ese grupo etáreo y se propone una jornada especial de pocas horas diarias y semanales para los trabajadores, cuya organización pueda ser objeto de sistemas de turno por parte del empleador. “Esto permite flexibilizar la administración del recurso humano por parte del empleador y compatibilizar trabajo y estudios por parte de los trabajadores”.

Finalmente, se impone la necesidad que el servicio prestado sea objeto de un sueldo acorde a la jornada parcial y proporcional al ingreso mínimo mensual, pudiendo en este caso alcanzar a un tercio de dicho ingreso. Al mismo tiempo, se incluyen normas protectoras de lo que, en definitiva, constituye la parte más importante del ingreso de estos trabajadores como son las propinas que reciben de parte de los clientes del supermercado, estableciendo que los empleadores no pueden hacer deducción alguna a este beneficio.
